Hudbox Terms of Service

1. Service Provider

The operator of the online platform Hudbox, available at https://hudbox.cz (the “Service”), is:

The Service Provider operates as a self-employed individual (sole trader) under a Czech trade license.

2. Nature of the Service

Hudbox is an online community platform focused on sharing music and multimedia content and enabling communication between users.

The Service may allow users in particular to:

• register and manage user accounts,
• create public and private profiles,
• upload and share content (text, music, photos, video, live streams),
• communicate via messages and chat,
• interact through comments and reactions,
• use paid features or subscriptions,
• subscribe to newsletters (if available).

Users are primarily responsible for the content they publish. The Service Provider may take action regarding content as permitted by these Terms and applicable law.

3. Responsibility for User Content

The user is fully responsible for any content they upload, publish, or otherwise make available through the Service (“User Content”).

In particular, the Service Provider:

• does not acquire ownership rights to User Content,
• does not perform blanket pre-moderation of all User Content,
• may remove or restrict access to content that violates these Terms or applicable law, or threatens the security of the Service.

The user must not publish content that, in particular:

• infringes copyright or other rights of third parties,
• contains malware, harmful code, or is intended to compromise security,
• constitutes unsolicited communications (spam) or deceptive advertising,
• contains threats, incites violence, or encourages unlawful conduct,
• is unlawful under Czech law or European Union law.

Reporting content and users

The Service allows users to report inappropriate content or users via the “Report” feature (available for both content and user profiles), or by email at info@hudbox.cz.

Reports should include, where possible: a link to the content/profile, a description of the issue, and any relevant information or evidence. The Service Provider will review the report and may take measures depending on severity (e.g., removal/restriction of content, feature limitations, temporary suspension, or account termination).

If content is reported as infringing copyright or other third-party rights, the Service Provider may temporarily restrict its availability (e.g., hide the content) while the report is reviewed and handled.

Appeal (review of enforcement action)

If a user’s account is restricted or their content is removed/restricted, the user may request a review (appeal) by contacting info@hudbox.cz. The request should include account identification and a brief explanation of why the user believes the action was incorrect. The Service Provider will assess the request within a reasonable time and communicate the outcome.

4. Acceptable Use

By using the Service, the user agrees to behave respectfully, comply with applicable laws, and respect other users.

Prohibited conduct includes in particular:

• Hate speech – content that attacks individuals or groups based on race, gender, nationality, religion, ethnicity, sexual orientation, or similar characteristics.
• Bullying and harassment – repeated unwanted contact, threats, insults, targeted humiliation, or stalking.
• Illegal activities – fraud, phishing, identity theft, or other unlawful conduct.
• Endangering minors – any content or activity that may harm, exploit, or endanger minors.

5. Spam and Abuse

Zero tolerance applies in particular to:

• unsolicited messages and mass messaging,
• automated account creation or artificial boosting of interactions,
• attempts to breach security or bypass technical restrictions.

The Service Provider may restrict, block, or terminate such accounts without delay.

6. Adult Content

It is prohibited to publish, in particular:

• illegal pornography,
• content depicting abuse of persons or sexual violence,
• material that violates applicable laws or third-party rights.

The Service Provider may remove or restrict inappropriate content and take further measures depending on severity.

7. Limitation of Liability

The Service is provided “as is”.

The Service Provider is not liable in particular for:

• temporary unavailability of the Service or limited functionality,
• loss of data or content due to technical failures, force majeure, or actions of third parties,
• content published by users,
• damages arising from the use of the Service, unless mandatory law provides otherwise.

The user uses the Service at their own risk.

8. Age Requirements and Users Under 15

The Service may also be available to persons under the age of 15.

By registering, the user confirms that:

• they have the consent of their legal guardian, or
• the account was created as part of a school activity with the school’s consent and in accordance with the school’s rules.

To the extent applicable, the legal guardian or the school may be responsible for the minor’s actions.

The Service Provider may, in justified cases, request proof of such consent.

9. Paid Services and Subscriptions

Some features of the Service may be subject to a fee (e.g., annual paid plans and/or storage upgrades).

The user acknowledges that:

• paid features are typically enabled immediately after successful payment,
• subscriptions are typically sold for a 1-year term; after expiry the account may revert to BASIC if not renewed,
• subscriptions are not automatically renewed by default; if auto-renewal is introduced, it will be available only as an optional user setting,
• price changes do not affect already paid periods; the price valid at renewal/new purchase applies to the next period,
• payments are generally non-refundable, unless mandatory law requires otherwise or the Service was not provided properly.

Downgrade and storage handling after expiry:

• after the subscription ends, the account is downgraded to BASIC and BASIC limits apply,
• if a user exceeds BASIC limits after downgrade, the Service Provider may contact the user and offer options (e.g., renewal or a storage extension where available),
• if no solution is selected, excess content may be removed or made unavailable after a reasonable period (typically up to 30 days from downgrade) to align the account with BASIC limits.

Payments and payment providers:

• payments may be processed via providers (e.g., Stripe/PayPal),
• Hudbox does not store payment card details; payment data is processed by the relevant payment service provider.

10. Account Termination

The user may terminate their account at any time using the options available in the Service.

The Service Provider may restrict or terminate an account if the user, in particular:

• violates these Terms,
• violates applicable laws,
• endangers the security of the Service or other users.

After termination, User Content may be removed or anonymized depending on the Service settings and the nature of the content. User-initiated account deletion may result in irreversible data deletion.

11. Copyright and License to Content

The user retains all rights to their User Content.

By uploading content, the user grants the Service Provider a non-exclusive license necessary to:

• operate and maintain the Service,
• display and make the content available within the Service according to visibility settings,
• process the content technically (e.g., compression, previews) to enable display,
• promote the Service (e.g., showcasing public content in marketing materials), unless set otherwise for specific content.

The license lasts for as long as the content remains available on the Service, and where necessary for a reasonable period to ensure operation and backups.

The user acknowledges that:

• other users may view and share content within the scope of the visibility settings,
• public content may be shared outside the Service (e.g., via links),
• the user is responsible for having the necessary rights to publish the content and for clearing any third-party rights.

12. Content Privacy Settings

The Service may allow visibility options, for example:

• public,
• selected users,
• private.

The user is responsible for setting privacy correctly and acknowledges that certain content may, for technical reasons (e.g., caching), remain temporarily accessible even after a privacy change.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the Czech Republic.

14. Changes to the Terms

The Service Provider may amend or update these Terms from time to time.

Users will be informed of changes via the Service and/or by email where appropriate given the nature of the change.
